Terms of use

NMBR is a service of First Client LLC, doing business as NMBR. These terms are a binding agreement between you and NMBR. They apply whenever you visit getnmbr.com, install or use the NMBR browser extension, create an account, buy credits, or use any other feature we provide (together, the "Service"). If you do not agree with these terms, do not use the Service.

We may update these terms from time to time. The date above shows when they last changed. If you keep using the Service after a change, you accept the updated terms. If a separate written agreement between you (or your employer) and NMBR conflicts with these terms, that agreement controls.

Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service. The Service is built for lawful, professional outreach. If you use it on behalf of a company, you confirm you are authorized to bind that company to these terms.

Privacy

Our privacy policy explains what information we collect about you and how we use it. It is part of these terms. Information about how we source contact data is on our data sources page, and anyone can ask to be excluded from results through our opt-out page.

Your account

You must provide accurate information when you create an account and keep it current. You are responsible for everything that happens on your account, so protect your sign-in credentials. Do not share your account, use someone else's account without permission, or transfer your account to anyone. If you believe someone accessed your account without permission, contact us right away.

Credits and payments

Paid features run on prepaid credits sold in one-time packs. Prices are shown before you buy, and the credit cost of each action (for example, finding an email or a phone number) is shown before you run it. Credits are only spent when the Service returns a contact; unsuccessful lookups are free, and re-opening a contact you already unlocked does not cost additional credits.

Payments are processed by Stripe; we never see or store your full card details. Credits have no cash value, cannot be transferred or resold, and purchases are final except where the law requires otherwise. If we ever discontinue the Service, unused purchased credits will be refunded on a pro-rata basis.

The data you receive

NMBR returns direct contact information, meaning email addresses and phone numbers, sourced from licensed third-party data providers. Phone numbers may include direct dials and mobile numbers, and a returned email address or number may be one the person also uses personally. Contact data changes constantly, and no provider can guarantee that every result is accurate, complete, or current. Results are provided for lawful, professional, one-to-one outreach only.

You are responsible for how you use the data. That includes complying with the laws that apply to your outreach: CAN-SPAM and similar rules for email; the TCPA, state telemarketing laws, and do-not-call rules for calls and text messages; and GDPR, CCPA, and similar privacy laws in your market. It also includes honoring unsubscribe, stop, and opt-out requests you receive. When a person opts out through NMBR, we suppress them from future results; you must handle any data you already received in line with applicable law.

Acceptable use

Our acceptable-use policy is part of these terms. In short, you must not:

  • use the Service, or data from it, for anything unlawful, fraudulent, or harmful, including harassment, stalking, discrimination, or unlawful marketing;
  • resell, redistribute, or publish results, or use them to build or enrich a competing product or database;
  • scrape, crawl, or run automated bulk collection against the Service, or probe, bypass, or interfere with its security or rate limits;
  • copy, modify, reverse engineer, or create derivative works of the Service;
  • upload malicious code or use the Service to distribute it.

We may suspend or terminate access that violates these terms or puts the Service or other users at risk. You can stop using the Service and close your account at any time.

Third-party platforms

The NMBR extension displays alongside third-party websites such as LinkedIn. NMBR is not affiliated with, endorsed by, or sponsored by LinkedIn or any other platform. Your use of those platforms is governed by their own terms, and you are responsible for your accounts and conduct there. Links to other websites do not mean we endorse them, and we are not responsible for their content or policies.

Our property

The Service, including its software, design, brand, logos, and content, belongs to NMBR and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes while these terms are in effect. If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you.

Disclaimer of warranties

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that any result will be accurate or complete. You use the Service at your own risk.

Limitation of liability

To the fullest extent the law allows, NMBR and its affiliates, suppliers, and partners will not be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, lost revenue, or lost data) arising from or related to the Service, even if we were advised such damages were possible. Our total liability for all claims combined is limited to the greater of (a) the amount you paid NMBR in the twelve months before the claim arose, or (b) one hundred US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold harmless NMBR and its officers, employees, and partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any law or third-party right, including how you use data obtained through the Service.

Copyright complaints

If you believe content available through the Service infringes your copyright, email alex@firstmillionviews.com with a description of the work, the location of the material, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We review and act on valid complaints promptly.

General

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and disputes must be brought in the state or federal courts located in Florida. If any provision of these terms is found unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them as part of a merger, acquisition, or sale of assets. By using the Service you agree to receive service-related communications from us electronically, and you can unsubscribe from marketing messages at any time. These terms, together with the policies they link to, are the entire agreement between you and NMBR about the Service.
